Damien heads Philip Lee’s litigation and dispute resolution unit and has extensive experience of handling commercial disputes across a broad range of sectors including, in particular, public procurement and competition and EU law. He has acted for a large number of both public and private sector clients in High Court judicial review proceedings involving challenges to the award of public contracts, including cases heard before the Commercial Court and, more recently, the newly established Competition Court. In addition to civil law actions involving abuse of dominance and cartel activity, Damien has also handled the defence of criminal prosecutions brought against private parties for breaches of competition law.
Damien’s practice also incorporates contentious work in the construction sector, including the conduct of arbitrations relating to a number of large public infrastructural projects. In 2002, he acted for the applicants in proceedings that secured an injunction against Dun Laoghaire Rathdown County Council prohibiting the carrying out of works on the extension of the M50 at Carrickmines Castle.
Damien graduated from University College Cork with a BCL (Hons) degree in law in 1995. In 1996, he also obtained a Master’s degree in law (LL.M) from UCC. In 2003 he completed a Diploma in Arbitration law at University College Dublin.
